Adjudication

Construction adjudication, start to decision

Adjudication gives a binding decision in around 28 days. It moves fast, so preparation is everything. We handle referrals and defences for both sides.

What we handle

  • Smash-and-grab claims: where a payment or pay less notice was missed
  • True value adjudications: to settle what the work is actually worth
  • Defects and set-off: proving defective work and its cost
  • Final account disputes: variations, dayworks and cost-plus charges
  • Defending a referral: responses, evidence bundles and jurisdiction points
  • After the decision: advice on payment, enforcement and stays, with solicitors where needed

Been served a notice of adjudication?

The clock is already running. The referral usually follows within 7 days, and you may have as little as 7 to 14 days to respond. Call us the day it arrives.

The adjudication timetable

The typical route under the Scheme for Construction Contracts.

Notice of adjudication

The referring party sets out the dispute and the remedy sought.

Adjudicator appointed (within 7 days)

Named in the contract or nominated by an adjudicator nominating body.

Referral notice (within 7 days of the notice)

The full claim, with the evidence and submissions.

Response and replies

The responding party answers, usually within a timetable set by the adjudicator.

Decision (28 days from referral)

Extendable by 14 days with the referring party's consent, or longer if both agree. Binding until finally decided by the court or by agreement.
